JOINT NOTICE OF PRIVACY PRACTICES

This Notice of Privacy Practices (“Notice”) explains how Gaylord Hospital and its affiliated entities may use and disclose your health information, how we protect it, and how you can exercise your rights.


Gaylord Hospital values your privacy and is committed to protecting the medical and other personal information about you and all our patients. Federal and state law require us to maintain the privacy and security of your protected health information (“PHI”) and to provide you with notice of our legal duties and privacy practices, as well as your rights regarding your health information.


Who Will Follow This Notice?

This Notice describes the privacy practices of Gaylord Hospital, Gaylord Farms Rehabilitation Center, related entities, and their respective facilities and programs, including facilities located throughout Connecticut (collectively, “Gaylord”).

This is a Joint Notice of Privacy Practices and applies to Gaylord inpatient, outpatient, therapy clinics, and other Gaylord-affiliated programs involving the use or disclosure of PHI. The privacy practices described in this Notice will also be followed by:

• Physicians and other practitioners who are members of Gaylord’s medical staff or who practice at Gaylord facilities

• All employees, trainees, students, and volunteers at any Gaylord location

• Health care professionals who provide services to you at Gaylord

• Business associates and partners who perform services for Gaylord and require access to PHI

These individuals and entities may share PHI with one another as necessary to coordinate your care and for other purposes described in this Notice. While many of these entities work together in a clinically integrated setting, some are separate legal entities.

Purpose of This Notice

This Notice describes:

• How we may use and disclose your PHI for treatment, payment, and health care operations (TPO) and other lawful purposes

• Your rights regarding your health information

• Our legal responsibilities to safeguard your information

This Notice applies to all PHI created or received by Gaylord Hospital, whether in paper, electronic, or verbal form.

How We Provide This Notice

We will:

• Post this Notice in prominent locations throughout our facilities

• Make it available on our website

• Offer a paper or electronic copy to patients upon request

You may request a paper copy at any time, even if you previously agreed to receive this Notice electronically.

We reserve the right to change this Notice. Any changes will apply to PHI we already have and to information received in the future. Updated Notices will be available upon request, posted in our facilities, and posted on our website.

What Is Protected Health Information (PHI)?

PHI is information that:

• Identifies you or could reasonably be used to identify you

• Relates to your past, present, or future physical or mental health or condition

• Relates to the provision of health care to you or payment for that care

PHI may be created, used, stored, or shared verbally, electronically, or in writing.

How We Use and Disclose Your PHI (Without Your Authorization)

For Treatment

We may use or disclose PHI to provide, coordinate, or manage your health care. Example: Sharing therapy notes or discharge summaries with your referring provider.

For Payment

We may use or disclose PHI to bill and collect payment from health plans or other payers. Example: Submitting claims or providing documentation to support medical necessity.

Your Right to Restrict Insurance Disclosure: If you pay out-of-pocket, in full, for a specific service or item, you may request that we not disclose information about that service to your health plan for payment or operations. We will honor this request unless disclosure is required by law.

For Health Care Operations

We may use or disclose PHI for operational purposes such as quality improvement, training, accreditation, licensing, auditing, compliance, and business management activities.

Use of Artificial Intelligence and Ambient Listening Tools We may use secure technologies, including artificial intelligence (AI) tools, to support treatment, payment, and healthcare operations. This may include tools that listen to and process conversations between you and your healthcare providers to assist with clinical documentation. These tools are designed to help improve accuracy and allow your care team to focus on you. Your healthcare providers review and approve all information before it becomes part of your medical record.

Other Permitted Uses and Disclosures

Subject to applicable law, we may disclose PHI for:

• Public health activities (disease reporting, public health surveillance)

• Health oversight activities (audits, investigations, inspections, licensure, accreditation)

• Reporting abuse, neglect, or domestic violence

• Judicial and administrative proceedings

• Law enforcement purposes

• Coroners, medical examiners, and funeral directors

• Organ and tissue donation

• Approved research activities with required safeguards

• Disaster relief efforts

• Public safety threats

• Workers’ compensation and similar programs

Business Associates

We may share PHI with business associates who perform services for us. All business associates are required by law and contract to protect the privacy and security of your PHI.

Additional Ways We May Contact You or Use Information

• Appointment reminders (mail, phone, voicemail, or electronic messaging)

• Care coordination and treatment alternatives

• Health-related services that may benefit you

• Hospital directory listings (unless you opt out)

• Individuals involved in your care or payment for care, unless you object

• Fundraising communications (you may ask to opt out at any time)

• Identity verification during registration

You may request confidential communications, such as using an alternate address or phone number.

Health Information Exchange (HIE)

Gaylord Hospital participates in the Connecticut Health Information Exchange (HIE), which allows health care providers involved in your care to securely share health information electronically for treatment, care coordination, quality improvement, and public health purposes, as permitted by law.

You have the right to opt out of having your health information shared through the HIE. Opting out will not affect your ability to receive care or benefits. To learn more about the HIE or to opt out, you may visit the Connecticut HIE website at https://www.conniect.org or contact Gaylord Hospital’s Privacy Officer for assistance.

Sensitive Health Information (Non-Part 2 Facility)

Gaylord Hospital is not a federally designated Substance Use Disorder (SUD) Part 2 program. However, certain types of health information receive additional protection under state or federal law, including:

• Mental health information

• HIV-related information

• Certain substance-related treatment information

When required, we will obtain your specific written authorization or comply with applicable legal requirements before disclosing such information.

Uses and Disclosures Requiring Your Written Authorization

We will obtain your written authorization before using or disclosing PHI for purposes not otherwise permitted by law. You may revoke an authorization in writing at any time, except to the extent action has already been taken.

Your Rights Regarding Your Health Information

You have the right to:

• Access your health information and obtain a paper or electronic copy in the format you request, when readily producible

• Request amendments to your health information

• Receive an accounting of disclosures made in the past six years (excluding TPO)

• Request confidential communications

• Request restrictions on certain uses or disclosures (we are not required to agree, except as required by law)

• Be notified of breaches of unsecured PHI without unreasonable delay

• File a complaint without fear of retaliation

Requests may be made during registration, during your stay, or by contacting the Privacy Officer. Some requests must be submitted in writing.

Patient Portal and Electronic Access to Health Information

Gaylord Hospital offers a secure patient portal that allows patients to access certain health information electronically, communicate with members of their care team, and manage aspects of their care. Use of the patient portal is optional.

We may make your protected health information available to you through the patient portal or by other electronic means, as permitted by law. You may also request access to your health information in paper form or in an electronic format of your choosing, when readily producible.

Gaylord Hospital uses reasonable administrative, technical, and physical safeguards to protect the privacy and security of health information accessed through the patient portal. However, no electronic system can be guaranteed to be completely secure. You are responsible for safeguarding your portal login credentials and for choosing whether to access your information electronically.
